Right to Jury Trial

Pursuant to 18-1-406 CRS, a defendant charged with a Class 1 Felony in Colorado is entitled to a trial by jury with 12 jurors. Generally, defendants can waive the right to jury trial, or the number of jurors. That is not the case in Class 1 Felonies in Colorado. Class 1 Felonies in Colorado are required to be heard by a jury of 12 jurors. Additionally, the defendant is entitled to a unanimous verdict from 12 jurors. The court, unlike in other felonies, has no discretion to reduce the number of jurors for verdict.
